Participation Waiver
In consideration of the participation of my child (named above) in the Manatee County sponsored event I, in my legal capacity as the parent/guardian of the minor named above, and on behalf of myself and the minor named above, my heirs, representatives, executors, administrators and assigns, hereby release, waive, forever discharge and covenant not to sue Manatee County, its officers, commissioners, directors, agents, employees, volunteers and representatives from any causes of action, claims, or demands of any nature whatsoever, including, but in no way limited to, claims of negligence against Manatee County, which I, the named minor, my heirs, representatives, executors, administrators and assigns may have, now or in the future, against Manatee County on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the use of the Manatee County facilities/equipment or participation in the Manatee County programs, whether the participation is supervised or unsupervised, however the injury or damage occurs, including but not limited to the negligence of Manatee County, its officers, commissioners, directors, agents, employees, volunteers or representatives.
I understand that there are certain inherent risks associated with the activity that Manatee County cannot predict, foresee or eliminate, regardless of the care taken to avoid injuries. I wish for my minor to participate despite the possible dangers and risks, and herein grant this release as a condition to participation and agree to assume and accept all risks associated with this activity. I further agree to indemnify and hold harmless Manatee County, its officers, commissioners, directors, agents, employees, and volunteers from and against any claims or actions which arise out of my minor's participation in this activity.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN: READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF MANATEE COUNTY AND ITS EMPLOYEES OR AGENTS USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY WHICH CANNOT BE ELIMINATED. BY SIGNING THIS FORM, YOU ARE GIVING UP YOUR CHILD’S RIGHT, AND YOUR RIGHT TO RECOVER FROM MANATEE COUNTY IN A LAWSUIT FOR ANY PERSONAL INJURIES, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND MANATEE COUNTY HASS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
Photo/Video Waiver
I hereby grant permission to Manatee County Government, as well as its agents, officers, employees and contractors, (hereinafter “the County”) to photograph, either still or video, my image, likeness, or depiction and/or that of my minor children (if applicable). I hereby grant permission to the County to edit, crop, or retouch such photographs, and waive any right to inspect the final photographs. I hereby consent to and permit photographs of me and/or those of my minor children (if applicable) to be used by the County worldwide for any County-government purpose, including educational, informational and advertisement purposes, and in any medium (print and electronic), including Website, Facebook, Twitter, Instagram and YouTube. I understand that the County may use such photographs with or without associating names thereto. I further acknowledge I have been promised no compensation for the photographs and waive any claim for compensation of any kind for the County’s use or publication of photographs of me and/or those of my minor children.
I hereby fully and forever discharge and release the County from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness or image) under either state or federal law, arising out of the use or publication of photographs of me and/or those of my minor children by the County for the above purposes, and covenant and agree not to sue or otherwise initiate legal proceedings against the County for such use or publication on my own behalf or on behalf of my minor children, and agree to indemnify and hold harmless the County from all claims and demands whatsoever arising out of or in connection with the foregoing. All grants of permission and consent, and all covenants, agreements and understandings contained herein are irrevocable. I acknowledge and represent that I am over the age of 18, have read this entire document, that I understand its terms and provisions, and that I have signed it knowingly and voluntarily on behalf of myself and/or my minor children (if applicable).
By signing below, I acknowledge that I have fully read, understand, and agree to the Manatee County Human Resources Release of Liability, Waiver for Participation and Photo/Video Waiver.
